1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and phingo ("phingo," "we," "us," or "our"), the operator of the online gaming platform accessible at phingo.app. By creating a phingo account, accessing the phingo website, or using any phingo service, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

2. Eligibility

To register and maintain an account on phingo, you must satisfy all of the following eligibility requirements:

• You must be physically located within a jurisdiction where online gaming is permitted under applicable law.
• You must not be a current employee, contractor, director, or officer of phingo, or an immediate family member of any such person.
• You must not have been previously excluded or banned from phingo or any affiliated platform.
• You must have the legal capacity to enter into a binding contract under Philippine law.

phingo reserves the right to request proof of age and identity at any time. Accounts found to be held by persons under 21 years of age will be immediately suspended, all winnings forfeited, and deposits returned at phingo's sole discretion.

3. Account Registration

Each individual may hold only one (1) phingo account. The creation of multiple accounts by a single individual is strictly prohibited and may result in the permanent suspension of all associated accounts and the forfeiture of any balances therein.

When registering for a phingo account, you agree to provide accurate, current, and complete information. You must promptly update your account information if any details change. phingo is not liable for any loss or damage arising from your failure to maintain accurate account information.

You are solely responsible for maintaining the confidentiality of your phingo login credentials, including your username and password. You must not share your phingo account credentials with any third party. phingo will not be liable for any unauthorized access to your account resulting from your failure to keep your credentials secure. If you suspect unauthorized access to your phingo account, you must notify phingo support immediately.

phingo reserves the right to conduct identity verification (KYC) procedures at any time, including but not limited to requesting a government-issued ID, proof of address, and proof of payment method ownership. Failure to complete KYC verification may result in the suspension of your account and the withholding of withdrawals pending verification.

4. Deposits and Withdrawals

All financial transactions on phingo are denominated in Philippine Peso (PHP). phingo supports deposits and withdrawals via approved payment methods including GCash, PayMaya, BPI, BDO, and Metrobank, subject to availability and applicable transaction limits.

The minimum deposit amount on phingo is ₱100. Minimum and maximum withdrawal amounts are as specified in the phingo cashier section and may be updated from time to time. phingo does not charge fees on standard deposits or withdrawals; however, your payment provider may impose their own transaction fees, for which phingo bears no responsibility.

Withdrawals will only be processed to a payment method that has been verified as belonging to the account holder. phingo will not process withdrawals to third-party accounts. phingo reserves the right to conduct additional verification checks before processing any withdrawal request. Withdrawal processing times vary by payment method but phingo endeavors to process approved withdrawals promptly.

phingo reserves the right to reverse a withdrawal request and return funds to your phingo account balance if the withdrawal cannot be completed for any reason, including but not limited to failed KYC verification, suspected fraudulent activity, or technical issues with the payment provider.

5. Bonuses and Promotions

phingo may offer bonuses, free bets, free spins, cashback, and other promotional incentives to eligible players from time to time. All phingo bonuses are subject to the specific terms and conditions of each promotion, including wagering requirements, minimum odds, game restrictions, time limits, and maximum withdrawal limits derived from bonus funds.

Unless otherwise stated in the specific promotion terms, the following general bonus conditions apply to all phingo promotions:

• Bonuses may only be claimed once per eligible player, household, IP address, device, or payment method unless explicitly stated otherwise.

phingo uses certified Random Number Generator (RNG) technology for all applicable games to ensure fair and unpredictable outcomes. Live dealer games are conducted by trained dealers using certified equipment. phingo does not manipulate game outcomes in any way.

In the event of a technical malfunction, disconnection, or error during gameplay, phingo reserves the right to void the affected game round and return the wager to the player's account. phingo's decision in such matters is final. phingo is not liable for any losses arising from technical failures beyond its reasonable control.

7. Prohibited Conduct

The following conduct is strictly prohibited on phingo and may result in immediate account suspension, forfeiture of funds, and referral to relevant authorities:

• Using automated software, bots, scripts, or any artificial intelligence tools to interact with phingo games or services.
• Engaging in collusion, chip dumping, or any form of cheating in multiplayer games.
• Exploiting software bugs, errors, or vulnerabilities in phingo's platform. Any such vulnerabilities must be reported to phingo support immediately.
• Using phingo for any money laundering, fraud, or other illegal financial activity.
• Providing false or misleading information during registration or KYC verification.
• Accessing phingo from a jurisdiction where online gaming is prohibited.
• Allowing any third party to access or use your phingo account.

8. Responsible Gaming

9. Intellectual Property

All content on the phingo platform, including but not limited to text, graphics, logos, game software, audio, video, and the phingo brand name and logo, is the exclusive property of phingo or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use phingo solely for personal, non-commercial gaming purposes.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any phingo content without the prior written consent of phingo. Unauthorized use of phingo's intellectual property may result in legal action.

10. Limitation of Liability

To the maximum extent permitted by applicable Philippine law, phingo and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the phingo platform, including but not limited to loss of profits, loss of data, or loss of goodwill.

phingo's total aggregate liability to you for any claim arising out of or relating to these Terms or your use of phingo shall not exceed the total amount deposited by you into your phingo account in the thirty (30) days preceding the event giving rise to the claim.

phingo does not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. phingo is provided on an "as is" and "as available" basis.

11. Privacy

phingo collects, processes, and stores your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using phingo, you consent to the collection and processing of your personal data as described in the Privacy Policy.

12. Amendments to These Terms

phingo reserves the right to amend, update, or replace these Terms at any time. When material changes are made, phingo will notify registered users via email or a prominent notice on the phingo platform. The date of the most recent revision will be indicated at the top of this page. Your continued use of phingo following the effective date of any amendment constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or in connection with these Terms or your use of phingo that cannot be resolved through good-faith negotiation shall be submitted to the exclusive jurisdiction of the competent courts of the Philippines.

Before initiating any formal legal proceedings, you agree to contact phingo support and allow phingo a reasonable period of not less than thirty (30) days to resolve the dispute informally.
